The National Code 2018 restricts the payment of commission where Standard 4.7 applies, and such payments are not permitted under Standard 4.8 for overseas students. On the other hand, section 6BA (Meaning of education agent) and section 6BB (Meaning of education agent commission) under the ESOS Act are drafted very broadly and appear to cover almost every type of monetary and non-monetary benefit or activity. This is the primary reason there is no fee charged to education providers to use this system. The purpose of the system is to achieve the best outcomes for students, and students may voluntarily donate to support the system. However, education providers are not permitted to pay any fee, whether monetary or non-monetary, unless there are future developments or clarifications issued by the relevant ESOS regulatory authorities in Australia.
